Even a person driving on a quiet road in a vehicle with no passengers can face serious distractions, potentially resulting in a car accident. When there are children involved, it is understandable that a driver has even more distractions. The simple act of handing a child a drink, for example, could have serious implications. Unfortunately, police in North Carolina believe that a man was actually under the influence when he was involved in an accident that injured his young children; he now faces accusations of DWI.
The incident that ultimately led to the man's arrest happened at approximately 9:30 p.m. on a day in March. According to reports, a 29-year-old man was driving a vehicle on a North Carolina road; his 14-month-old daughter and 5-year-old son were passengers. Unfortunately, police say that the vehicle veered of the road before rolling multiple times and coming to a stop in the woods.
The toddler was reportedly ejected from the vehicle in the crash. Even though police believe that the vehicle landed on her, she is in stable condition. The boy was treated at the hospital and released. The driver now faces multiple charges, including felony serious injury with a vehicle, misdemeanor child abuse and DWI.
There are many events related to the accident that are unclear at this time, including what led police to believe that the accident was related to alcohol and what evidence supports the DWI and other charges the man is facing. While tragic, some North Carolina accidents are simply due to a minor miscalculation and not because the person was engaging in illegal behavior. An attorney with experience with such cases can help the man sort through the evidence against him and create an appropriate plan of action.
